By accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Board Forge Co.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use our Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Your continued use of the Services after any modifications to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Certain features of our Services require you to create an account. Account registration and authentication are managed through Netlify Identity. When you create an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security and confidentiality of your login credentials, including your password.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately at support@boardforgeco.com if you suspect any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, misleading, or in violation of these Terms. You are solely responsible for any activity conducted through your account, whether or not you authorized that activity. Board Forge Co. will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

Board Forge Co. offers the following categories of products and services:

a) Custom Board Games

Our flagship offering consists of bespoke, handcrafted board games personalized with your photos, names, and memories. Custom games range from $89 to $349, depending on the complexity, components, and level of personalization selected. Each custom game is a unique, made-to-order product crafted specifically for you.

b) Merchandise

We sell branded and gaming-related merchandise, including but not limited to play mats, premium dice sets, game bags, carrying cases, apparel, and accessories. These items are available for purchase directly through our Site.

c) Classic Games (Nostalgia Collection)

We curate and feature classic board games available for purchase through Amazon. These products are sold by third-party sellers on Amazon, and we earn a commission on qualifying purchases made through our affiliate links. Board Forge Co. does not sell, ship, or handle returns for these products directly. Please refer to Section 11 (Affiliate Links Disclaimer) for further details.

d) Virtual Gaming App

Board Forge Co. offers a virtual gaming application available for download. The App is available for a one-time download fee of $1.99 and offers an optional premium subscription at $2.99 per month, which unlocks additional features, game modes, and content. Please refer to Section 10 (Virtual Gaming App Terms) for full subscription and in-app purchase terms.

Ordering a custom board game from Board Forge Co. involves a collaborative design process. By placing a custom game order, you agree to the following terms:

a) Design Process

After placing your order, our design team will work with you to create your personalized game. You will be asked to submit photos, text, names, and other personalization details. You are responsible for providing all requested materials in a timely manner. Delays in providing design materials may result in extended production timelines.

b) Photo Ownership & Submissions

By uploading photos and personal content for use in your custom game, you represent and warrant that you own the rights to all submitted materials or have obtained the necessary permissions from the rights holder(s). You retain full ownership of your photos and content. However, you grant Board Forge Co. a limited, non-exclusive, royalty-free license to use, reproduce, and modify the submitted materials solely for the purpose of producing and delivering your custom game order. This license terminates upon delivery of your completed order, except as needed for customer support, reprints, or order history records.

c) Production Timeline

Custom board games are handcrafted products. Typical production timelines range from 3 to 6 weeks after design approval, depending on order complexity, component availability, and current order volume. Production timelines are estimates and not guaranteed delivery dates. We will communicate any significant delays to you as promptly as possible.

d) Design Approval

Before your custom game enters final production, we will provide you with a digital proof or design preview for your review and approval. You will have the opportunity to request reasonable revisions. Once you approve the final design, production will begin. After approval, no further changes can be made, and the order cannot be canceled. Board Forge Co. is not responsible for errors in the final product that were present in the customer-approved design proof.

All prices displayed on the Site are listed in United States Dollars (USD) unless otherwise stated. Prices are subject to change without prior notice, but changes will not affect orders that have already been confirmed.

Payment processing is handled securely through Shopify. We accept major credit cards (Visa, Mastercard, American Express, Discover), debit cards, Apple Pay, Google Pay, Shop Pay, and other payment methods supported by Shopify Payments. All payment information is transmitted using industry-standard SSL/TLS encryption and is processed in compliance with PCI DSS standards.

You agree to pay all charges incurred in connection with your purchases at the prices in effect when the charges are incurred, including all applicable taxes, shipping fees, and handling charges. Applicable sales tax will be calculated and added at checkout based on your shipping address and the tax laws of the applicable jurisdiction.

Board Forge Co. reserves the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, or suspected fraudulent activity. If your order is canceled after payment has been collected, you will receive a full refund.

Board Forge Co. currently ships to addresses within the United States. International shipping may be available for select products and will be indicated at checkout where applicable.

Shipping costs are calculated at checkout based on the weight, dimensions, and destination of your order. Estimated delivery times are provided at checkout and in your order confirmation email, but these estimates are not guaranteed. Actual delivery times may vary depending on carrier performance, weather, customs processing (for international orders), and other factors beyond our control.

Risk of loss and title for items purchased from our Site pass to you upon delivery of the items to the carrier. Board Forge Co. is not responsible for delays, loss, or damage caused by the shipping carrier after the order has been handed off for delivery.

If your order arrives damaged, please contact us at support@boardforgeco.com within 7 days of delivery with photos of the damage and your order number. We will work with you to resolve the issue, which may include a replacement or refund at our discretion.

Our return and refund policy varies based on the product category:

a) Custom Board Games

Due to the personalized nature of our custom board games, all custom game orders are final and non-refundable once the design has been approved and production has begun. Each custom game is made specifically for you using your personal photos, names, and design choices, making it unsuitable for resale. If your custom game arrives with a manufacturing defect (e.g., misprinted components, missing pieces, or structural damage not caused during shipping), please contact us within 14 days of delivery and we will arrange a replacement or repair at no additional cost.

b) Merchandise

Standard merchandise (play mats, dice, bags, apparel, and accessories) may be returned within 30 days of delivery for a full refund or exchange, provided the item is unused, in its original packaging, and in resalable condition. Personalized or custom-printed merchandise is subject to the same non-refundable policy as custom board games. To initiate a return, contact us at support@boardforgeco.com with your order number. Return shipping costs are the responsibility of the customer unless the return is due to a Board Forge Co. error or defective product.

c) Classic Games (Amazon Affiliate Products)

Classic games purchased through our Amazon affiliate links are sold and fulfilled entirely by Amazon and its third-party sellers. All returns, refunds, and customer service inquiries for these products must be directed to Amazon in accordance with Amazon's return policy. Board Forge Co. has no control over and assumes no responsibility for the fulfillment, condition, or return of these products.

d) Virtual Gaming App & Subscriptions

The one-time App download fee is non-refundable once the App has been downloaded and installed. Subscription refunds are subject to the refund policies of the platform through which the subscription was purchased (e.g., Apple App Store, Google Play Store). If you experience technical issues with the App, please contact us and we will make reasonable efforts to resolve the issue.

All content, features, and functionality of the Services — including but not limited to the Board Forge Co. name, logo, tagline ("Games That Tell Your Story"), website design, graphics, text, images, software, game designs, product designs, and all other intellectual property — are owned by Board Forge Co. or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Services without our prior written consent, except as follows:

• Your computer may temporarily store copies of materials incidental to your accessing and viewing those materials.
• You may print or download one copy of a reasonable number of pages for your own personal, non-commercial use.
• You may share links to our Site on social media, provided you do so in a way that is fair and does not damage our reputation.

User-Uploaded Content: Photos, images, text, and other content you submit for custom game production remain your property. By uploading this content, you grant Board Forge Co. a limited, non-exclusive, royalty-free license to use, reproduce, modify, and incorporate the content solely for the purpose of fulfilling your order, providing customer support, and maintaining order records. We will not sell, share, or use your uploaded content for marketing purposes without your explicit written consent.

If you believe that any content on our Services infringes your intellectual property rights, please contact us at legal@boardforgeco.com with a detailed description of the alleged infringement.

You are solely responsible for all content you upload, submit, or transmit through the Services ("User Content"). By submitting User Content, you represent and warrant that:

• You own or have the necessary rights and permissions to use and authorize the use of your User Content.
• Your User Content does not infringe upon the intellectual property, privacy, publicity, or other rights of any third party.
• Your User Content does not contain any material that is defamatory, obscene, abusive, offensive, hateful, or otherwise objectionable.
• Your User Content does not violate any applicable law or regulation.

You agree not to use the Services to:

• Upload or transmit viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to our systems, servers, or other users' accounts.
• Interfere with or disrupt the integrity or performance of the Services.
• Use any automated means (bots, scrapers, crawlers) to access or collect data from the Services without our prior written permission.
• Engage in any fraudulent, deceptive, or misleading activity.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.

Board Forge Co. reserves the right to remove any User Content that violates these Terms and to suspend or terminate the account of any user who engages in prohibited conduct, at our sole discretion and without prior notice.

The following terms apply specifically to the Board Forge Co. virtual gaming application:

a) Download & License

The App is available for download for a one-time fee of $1.99. Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on compatible devices that you own or control, for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or disassemble the App or any portion thereof.

b) Premium Subscription

The App offers an optional premium subscription at $2.99 per month, which provides access to additional game modes, exclusive content, enhanced features, and ad-free gameplay. Subscriptions automatically renew each month unless canceled at least 24 hours before the end of the current billing period. You may manage your subscription and turn off auto-renewal through your device's app store account settings. Subscription fees are billed through the platform from which you downloaded the App (Apple App Store or Google Play Store) and are subject to that platform's terms and billing practices.

c) In-App Purchases

The App may offer additional in-app purchases for virtual items, game expansions, or cosmetic upgrades. All in-app purchases are final and non-refundable, except as required by applicable law or the policies of the platform through which the purchase was made. Virtual items purchased within the App have no real-world monetary value and cannot be exchanged, transferred, or redeemed for cash.

d) App Availability & Updates

Board Forge Co. reserves the right to modify, update, suspend, or discontinue the App or any of its features at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App. We may release updates that you will need to install in order to continue using the App. Failure to install updates may result in limited functionality or inability to use certain features.

Our Site contains affiliate links to products sold on Amazon.com. Board Forge Co. is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com.

When you click on an affiliate link and make a purchase on Amazon, Board Forge Co. may receive a small commission at no additional cost to you. These commissions help support the operation of our Site and the development of new products and content.

Board Forge Co. does not control and is not responsible for the products, pricing, availability, shipping, or customer service for items purchased through Amazon affiliate links. Your purchase of products through Amazon is governed solely by Amazon's terms of service, return policies, and privacy policy.

Our recommendations and product selections in the Nostalgia Collection are based on our genuine interest in classic board games. While we receive compensation through the affiliate program, our editorial choices are not influenced by whether or not a product has an affiliate link.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOARD FORGE CO., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your access to, use of, or inability to access or use the Services.
• Any conduct or content of any third party on the Services, including without limitation any defamatory, offensive, or illegal conduct of other users or third parties.
• Any content obtained from the Services.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any products purchased through third-party affiliate links.

IN NO EVENT SHALL BOARD FORGE CO.'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BOARD FORGE CO. IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100).

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BOARD FORGE CO. DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We value our customers and aim to resolve any disputes amicably. If you have a concern or dispute regarding the Services, please first contact us at support@boardforgeco.com so we can attempt to resolve the matter informally. We will make good-faith efforts to address your concerns within 30 days.

If the dispute cannot be resolved informally, you and Board Forge Co. agree that any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in the English language, and the seat of arbitration shall be in the State of Delaware, United States.

Class Action Waiver: You and Board Forge Co. agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Board Forge Co.

Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

You may terminate your account at any time by contacting us at support@boardforgeco.com. Upon termination, your right to use the Services will immediately cease.

Board Forge Co. reserves the right to suspend or terminate your account and access to the Services at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms, suspected fraudulent activity, or conduct that we determine to be harmful to other users, us, or third parties.

Upon termination, the following provisions shall survive and remain in full force and effect: Intellectual Property (Section 8), Limitation of Liability (Section 12), Dispute Resolution (Section 13), Governing Law (Section 15), and any other provisions that by their nature should survive termination.

Termination of your account will not affect any orders already in production. Custom game orders that have been approved and entered production will be completed and shipped regardless of account status. Any outstanding payment obligations will remain due.

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Delaware and the applicable federal laws of the United States of America, without regard to conflict of law principles.

To the extent that any lawsuit or court proceeding is permitted under these Terms (for example, claims that fall outside the scope of the arbitration agreement), you and Board Forge Co. agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in the State of Delaware. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

Board Forge Co. reserves the right to modify, update, or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page and, for material changes, we may provide additional notice through the Site, via email to registered account holders, or through the App.

Your continued use of the Services after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services and, if applicable, cancel your account and any active subscriptions.

We encourage you to review these Terms periodically to stay informed about our terms and conditions. Material changes will not be applied retroactively to orders that have already been placed and confirmed prior to the effective date of the revised Terms.
